If you are in regular employment the opportunities to obtain refunds is pretty limited, unless you are asked as part of your employment to pay for certain purchases yourself and reclaim from the company. Retaining the receipts for business expenses is vital, best to use a small folder and log each purchase.

The most common claim against an employer is compensation for loss of job or redundancy, most of which is covered under traditional employment law, plus your personal contract of employment so most situations will cause little problems.

Your trade union, or receiver of a company (if in liquidation) can assist with advice when claiming, as well as your local benefits and/or employment office.

Personal injury and/or illness caused by the working environment are areas where you are likely to have the need to make a claim against your company. More than likely claims are covered by insurance and a claims form would usually be needed to be completed setting out the basis of your claim.

A large number of organisations promote a "no win no fee" service, and many people believe they are in for huge payouts for simple injuries, whilst liability is often accepted earlier on, actual financial agreements may be lengthy and conducted under court proceedings. This can take several years.

Where liability is contested cases can drag on for many years, and even if successful the company or insurer may appeal.

Top tips

  • Maintain a simple diary of events

  • Keep all evidence you can, papers, photos, names and contact details of people who witnesses events etc

  • Review the basis of your claim regularly

  • Take professional advice from a solicitor (often you can obtain a first interview free, or maybe are, or can become entitled to Legal Aid)

  • Consider "No win, no fee" services offered by Solicitors BEFORE nationally advertised services, as several of the latter have collapsed creating delays and problems for clients cases in progress.

  Overpayments

Several Members have been "bullied" by a previously employer who suddenly finds an overpayment of wages, holiday pay etc is due back and demands instant repayment. Unless there is any real error or mis-information on behalf of the employee we take the view the employee should have right to expect to pay the monies due back over a period of time 1-2 years for large amounts. If the employer refuses to accept a deal write out 12 or 24 etc cheques pre dated each month with the first due now. It will be hard for the employer to refuse to accept such a deal, although they may not formally accept the offer. Banking cheque 1 seals a deal. Employees should retain copies or stubs of all cheques written in this way as well as bank statements showing payments clearing.
